This is the Data Protection and Privacy Policy of “E-Consulting” AC.

Associated Company “E-Consulting” (E-Consulting, “we”, “holder”, “controller” and “us”) may process information related to you (including personal data such as name, surname, phone number, e-mail, address, place of work, position, IP-address, geolocation etc.), including holding this information in a documentary form or in the form of an electronic database, to satisfy our contractual, regulatory or statutory requirements. Unless we receive specific written instructions to the contrary from you, you agree, that we may process this information to perform the abovementioned actions.

Introduction

The protection of the security and privacy of your personal data is important to us and to the way we conduct our business in compliance with laws on privacy, data protection and data security. The purpose of this policy is to determine the information we may collect, how we use and protect this information and with whom we may share it.

At E-Consulting, we are committed to adhere to the highest standards of integrity in our business. Personal data

Through our websites, we will not collect any personal information about you, such as your name, address, position, phone number or email address (“Personal Information”, “Personal Data”), unless you voluntarily provide it (e.g. by registration, email enquiry, survey etc.). If you do not want your personal information to be collected, please do not submit it.

By accepting our Data Protection and Privacy Policy, you agree to use your Personal Data as described below. You also consent transferring your Personal Data outside the European Union (our registered address is Kyiv, Ukraine) and to our vendor Microsoft Ireland Operations Limited (recipient, disposer of Personal Information) and its affiliates, to the extent that it is necessary for providing services to you or where we need to fulfill our legal obligations.

How does E-Consulting use your information/data?

We may use your information for any of the following purposes:

• confirmation of your identity;
• saving your personal profile;
• managing your account and keeping you informed on all matters that concern your account;
• providing the services you requested;
• contacting you when necessary or appropriate in relation to the services being provided to you;
• marketing campaigns and events, segmentation of clients into groups by industry and interests;
• analytics and creation of anonymous statistics;
• emailing;
• involving potential participants of the online and offline activities (including conferences, workshops, seminars, etc.);
• providing you with information about our products and services and providing you with information or opportunities that we believe might be relevant to you;
• transferring of collected Personal Information to our vendor – Microsoft Ireland Operations Limited and its affiliate Microsoft Ukraine LLC.

If you do not want your Personal Data to be used to support customer relationship management programs by E-Consulting (in particular, for direct marketing or market research), we will respect your choice.

E-Consulting cannot (and does not intend to in the future) sell, borrow or otherwise transfer your Personal Data to third parties, except for anonymous aggregate statistics.

You can opt out of receiving marketing emails at any time by clicking the “unsubscribe” link in the emails or by contacting our customer support team with your request. However, we will still be obliged to send you notices about changes in the terms and conditions of customer relationship programs and other important issues concerning your account.

Intelligent data collected automatically

When you access our website, we may automatically (i.e. not by registration) collect statistical information that is not personally identifiable (such as the type of web-browser and used operating system; domain name of the previous website from which you went to our website; spent time on our site, pages viewed). We may use this information and share it with our affiliates and partners to measure the extent of using our website and improve its content.

Generally, we require from any third-party service provider to whom we provide Personal Data, to accept an obligation to respect the privacy of any person and adhere to the principles of data protection.

Record storage

We will keep Personal Data only for as long as necessary, including for the purpose of updating the product, providing services, informing or complying with legal requirements. When Personal Data is no longer needed, it will be destroyed to prevent unauthorized access to information.

We safely protect your personal information from loss, destruction, tampering, manipulation and unauthorized access or unauthorized disclosure, as well as develop and maintain procedures for protecting Personal Data from loss, theft, copying and unauthorized disclosure, use, or modification. Access to Personal Data is controlled only by employees and authorized service providers who need this to carry out their work.

Access to your Personal Information

In accordance with the Law of Ukraine “On Protection of Personal Data” and the General Data Protection Regulation of the European Union, you have the right to receive any Personal Data that we hold about you and inform us of any inaccuracy. You may also request the removal or destruction of your Personal Data that we have or have been passed on to us by the recipient / manager (except those without which E-Consulting or the recipient / manager cannot further provide you services).

Right to request access to Personal Data

You have the right to require the controller to provide access to and correction or deletion of Personal Data or to restrict the processing concerning the Personal Data and to object to processing as well as the right to data mobility. Data mobility implies the right to receive Personal Data provided to the controller by you in a structured, commonly accepted, machine-readable format, and the right to transfer such data to another controller without interference from the controller who provided the personal data.
